These Terms of Service ("Terms") govern your use of exiduscreativeagency.com (the "Site"), operated by Jared Riley Forman and Jacob Elledge, doing business as Exidus Creative Agency ("Exidus," "we," "us"), based in Dallas–Fort Worth, Texas. By using the Site, booking a call, or submitting a form, you agree to these Terms.
Who this Site is for
This Site is intended for business owners and professionals exploring marketing and advertising services. It is not directed to children under 13.
What we do
Exidus provides marketing, advertising and content-production services to businesses, including paid ad production and management, organic content, and related marketing support. The specific services, pricing and terms for any paid engagement are set out in a signed Master Service Agreement and Order Form between Exidus and the client — these Terms govern use of the website itself, not the terms of a specific engagement. If anything here conflicts with a signed Master Service Agreement, the signed agreement controls for that engagement.
No guarantee of results
Browsing this Site, booking a call, or requesting information doesn't create a service relationship or guarantee any particular outcome. Where we do provide services under a signed agreement, we commit to delivering the work described in that agreement — we don't promise a specific number of leads, sales, or any other result, even where we reference a client's own reported results as an example of what's possible.
Your information and communications
By booking a call, submitting a form, or emailing us, you consent to being contacted by phone, email or text about your inquiry. If we ever use your phone number for ongoing marketing text messages, we'll ask for your separate, clear consent first, and you can opt out at any time. Intellectual property
The content on this Site — including text, graphics, logos and video — belongs to Exidus or its licensors and is protected by copyright and other laws. You may not copy, reproduce or use it without our written permission. Ownership of work we produce for a specific client is governed by that client's signed Master Service Agreement, not by these Terms.
Third-party services
This Site uses Cal.com for booking, Google for fonts, email and video calls, and Cloudflare for hosting and security. We aren't responsible for those services' own availability, content or policies — see our Privacy Policy for links to each.
No warranty
This Site and its content are provided "as is," without warranties of any kind, to the fullest extent permitted by law. We don't guarantee the Site will always be available, secure or error-free.
Limitation of liability
To the fullest extent permitted by law, Exidus isn't liable for any indirect, incidental or consequential damages arising from your use of this Site. For any paid engagement, our total liability is limited as described in the signed Master Service Agreement for that engagement.
Governing law
These Terms are governed by the laws of the State of Texas. Any dispute arising from these Terms or your use of this Site will be resolved in the state or federal courts located in Denton County, Texas.
Changes
We may update these Terms from time to time. The effective date at the top of this page reflects the most recent version.
